Cette texte est le reflet de la société française dans ce qu’il y a de plus moche, je veux parler de la haine alors que l’on s’apprête à voter des lois contre celle-ci.
Ça fait un bon moment qu’il y a du ménage à faire au sein du ministère de la Justice » ! et ça s’aggrave chaque jour ! Il n’y a qu’à lire la presse et les réseaux sociaux.
Et là aussi on voit que les politiques s’arrogent le droit de ne pas déclarer des revenus par exemple. On peut tout faire au niveau central.

Je ne suis pas un homme de rien (comme dirait M. MACRON). Mon seul recours est de faire connaitre comment des juges, qui ne font pas leur boulot, s’y prennent pour massacrer quelqu’un sans aucune preuve… d’où les préjugés cités plus haut !
Ayant subi une véritable avanie judiciaire, c’est une longue torture depuis 7 ans et je me dois de la raconter car il est dangereux de garder une telle avanie pour soi-même. Toutes mes nuits en sont hantées.
Le but est d’attirer l’attention sur le pouvoir des juges face à des justiciables honnêtes, et j’espère qu’il y a des exceptions parmi tous ces juges, ceci dans l’espoir que certains examinent les faits avant de condamner aux peines maximums uniquement par haine ou idéologie. Ils donnent l’impression de régler des comptes personnels à l’encontre de gens qu’ils n’aiment pas (un jour un avocat m’a dit « les juges détestent les conseillers financiers »). Vous allez en voir la démonstration dans les lignes qui suivent lorsqu’un juge m’a baptisé conseiller financier pour mieux me condamner et faire ainsi que son idéologie détrône les faits.
Pour illustrer un peu mon histoire voici une légende parlante :
La légende amérindienne du colibri, ce petit oiseau qui allait chercher quelques gouttes d’eau avec son bec pour les jeter sur l’immense feu qui ravageait la forêt. Son action provoqua un agacement de la part des autres animaux qui, terrifiés, observaient impuissants le désastre. Un tatou demanda alors au colibri : « Colibri ! Tu n’es pas fou ? Ce n’est pas avec ces gouttes d’eau que tu vas éteindre le feu ! ». Le colibri lui répondit : « Je le sais, mais je fais ma part. »
Cette légende s’avère être source d’inspiration. Je fais ma part.…je dénonce ce pouvoir des juges qui ont le permis de tuer sans être inquiétés. C’est bien du terrorisme judiciaire. Ils sont bien protégés. On l’a bien vu lors de l’affaire du mur des cons ou de celle d’Outreau ou encore celle du juge LACABANE ;
Ceci est un retour sur la révélation du scandale de l’entreprise AKZENTA en 2006 qui a opposé l’Allemagne et la France en la matière.
Il s’agit avant tout de légitime défense contre les jugements iniques perpétrés par des juges sans scrupules et décomplexés.
J’ai du mal à comprendre la haine de la part de certains juges quand ils ont décidé de massacrer. J’ai été victime de ces prédateurs ainsi que nombre de mes concitoyens, je pense.
A l’heure où l’on combat la haine dans notre société, on ferait bien de s’occuper de cette haine portée par l’administration judiciaire. « Un pouvoir sans limite cesse d’être légitime » dit-on.
Je vous raconte ici une injustice flagrante…et ce n’est pas la seule, je suppose…On dit qu’il n’y a pas de pouvoir sans injustice mais je pense qu’il y a des limites à ne pas dépasser.
2 parties :
1/ Ma carrière militaire, partie qui néanmoins inclut tous les membres de ma famille qui ont servi la République dans la gendarmerie, la police nationale et l’armée pendant toute leur vie. Vous voyez, nous avons tous été ultra républicains.
2/ A l’issue de cette carrière sans failles, comme l’ont précisé et répété mes différents chefs, j’ai désiré continuer à servir sous contrat opérationnel. Et c’est là que, ayant un peu d’argent de côté, je décide d’acheter 2 contrats de participation au chiffre d’affaires d’une valeur d’environ 10 000€ (TVA incluse), dans une entreprise allemande nommée AKZENTA. Ce concept était alors inconnu en France.
Ces contrats me rapportaient des sommes de l’ordre de 20€ mensuels mais étaient prévus me rapporter de plus en plus au cours des années suivantes de façon exponentielle, selon le chiffre d’affaires (entre 10 et 15 ans de long environ). Ces contrats commerciaux étaient assortis d’une TVA et étaient censés rapporter plus qu’un placement bancaire, sans intérêts comme des placements financiers, ni indexation donc en euro constant pendant toute la période. Cette entreprise a exercé son activité pendant 11 années (de 1995 à 2006).
Je passe les détails par soucis de concision.
Le pire est là.
J’en viens à mon histoire : Si vous avez le courage de lire jusqu’au bout, vous verrez comment un juge s’y prend pour condamner au maximum de la peine sans aucune preuve.
Au titre d’activités militaires sous contrat opérationnel, j’ai dû me déplacer, notamment à Creil. Au cours d’une période pour laquelle j’étais désigné, j’y ai rencontré un ancien collègue à l’issue du repas de midi. Une conversation s’est engagée sur nos devenirs respectifs. Je lui ai parlé de mes achats de participation au chiffre d’affaires dans la fameuse entreprise. Il a de suite été intéressé par le concept et m’a demandé de le lui présenter dans ma chambre d’hôtel que je louai pour une période d’une semaine. Ce que j’ai fait en ma qualité de partenaire de l’entreprise puisque je disposais de contrats sur mon ordinateur portable.
(A noter que selon la jurisprudence de la Cour de Cassation, un logement loué se trouve bien être le domicile de l’occupant. Dans ma condamnation le juge ne l’a pas reconnu.)
Cet individu a voulu acheter 3 contrats en six mois de temps (en octobre et décembre 2005 lors de mes déplacements à CREIL) et mars 2006 en Alsace. La somme de ces contrats atteignait plus de 60 000€. Les 2 premiers l’ont été lors de mes 2 périodes militaires en octobre et décembre 2005. Le troisième en mars 2006 pour lequel il s’est déplacé de 1000km depuis son domicile jusqu’en Alsace pour signer ce contrat par mon intermédiaire, ce que le juge reconnait dans son texte. Malgré l’avertissement noté dans les conditions particulières du contrat (« en cas de chiffre d’affaires nul, il n’y aura aucun versement »), M. FASQUEL a quand même risqué son argent, sans lire ses contrats. Le risque souligné était quand même important.
Malheureusement, l’entreprise a déposé son bilan en avril 2006 suite à, soi-disant, l’intervention des banques. Elle a été taxée de « système boule de neige » malgré la TVA encaissée par l’administration fiscale. Le PDG et ses associés ont été emprisonnés.
J’ai perdu mon argent ainsi que les 5 autres proches qui avaient contracté. J’ai moi-même porté le chapeau de cette débâcle commerciale alors que je n’étais qu’un simple citoyen ignare en la matière.
Mon honnêteté m’a conduit à avertir ces personnes qu’elles pouvaient contacter Me BERG, alors avocat à Strasbourg qui avait diffusé un mandat extrajudiciaire aux fins de récupérer l’argent investi moins 20% pour son profit personnel. J’ai moi-même établi un dossier qui m’a été refusé par Me BERG sous prétexte de conflit d’intérêt. PREMIERE PUNITION…
Comme cet avocat a échoué sur la récupération de l’argent investi dans cette entreprise, M. FASQUEL et Mme RUFFENACH ont porté plainte contre moi sous son impulsion. En effet, il comptait me faire rembourser ces plaignants par son intermédiaire et ainsi récupérer 20% des sommes. Ayant moi-même tout perdu, je n’étais pas enclin à rembourser des sommes que je n’ai pas encaissées.
Donc cet avocat m’a assigné en justice. En première instance, en février 2012, je juge l’a débouté, estimant que je n’étais pas responsable de la débâcle de l’entreprise ni des faits reprochés, étant donné que j’avais moi-même tout perdu.
L’affaire fût mise en appel. Et alors…déchaînement de Me BERG sur moi. Ma carte de visite a été falsifiée (effacement des mots : « au chiffre d’affaires » pour montrer au tribunal que l’investissement n’était pas commercial), des documents dévoyés pour étayer ses thèses. Puis sollicitation de Mme RUFFENACH pour déposer sa plainte en 2012 après 6 ans de non-versements et 3 ans après le dépôt de bilan. Condamnation à rembourser la plaignante lors des débats en juillet 2013. Donc condamné sur mes biens propres à rembourser la somme investie + TVA + intérêts légaux + art 700 etc. par la juge DECOTTIGNY.
DEUXIEME PUNITION
Pour l’affaire FASQUEL, les débats en appel ont eu lieu en mars 2014 en mon absence puisqu’on m’a caché la date de l’audience. Bafouage des droits de l’homme.
De là, matraquage à mon encontre ; martèlement du juge LIEBER qui me baptise « conseiller financier » sans preuve car ma carrière et mes spécialités militaires, étaient étrangères à quelque activité financière reprochée. De plus il s’agissait d’un contrat commercial au vu de la TVA appliquée.
Martèlement du juge qui m’oppose des articles du code monétaire et financier (rien à voir avec du commerce). TROISIEME PUNITION : condamné à rembourser M. FASQUEL, sur mes biens propres, tous les montants de ses contrats + la TVA + Intérêts légaux sur les montants et sur la TVA + article 700. Le tout atteignant la somme de 72 232 €.
Scandaleux ?
La déontologie ne doit pas faire partie du vocabulaire des juges car ils s’arrogent le droit de condamner sans aucune preuve (Montesquieu disait à ce propos : « Tout pouvoir sans borne cesse d’’être légitime »).
La France donne des leçons aux autres peuples en matière de droits de l’homme mais n’est pas encline à les faire respecter dans son propre pays ou du moins très faiblement et pas pour tous.
L’Etat de droit n’est pas le même pour tous… Si La France est le pays de la déclaration des droits de l’homme elle n’est pas le pays des droits de l’homme, voilà la différence.
Saint Augustin disait justement :
« À force de tout voir l’on finit par tout supporter … A force de tout supporter l’on finit par tout tolérer … A force de tout tolérer l’on finit par tout accepter … A force de tout accepter l’on finit par tout approuver ». Ça fait réfléchir …
J’ai passé ma vie au service de la France, 42 ans de carrière militaire. Dans cette institution, j’y ai rencontré et appliqué une vraie justice et une vraie confiance entre hommes.
L’administration militaire est la meilleure qui soit en métropole et hors métropole, si bien qu’à la retraite, dans le civil, nous n’avons pas les mêmes codes et je l’avoue, un peu perdus quant au fonctionnement de l’administration civile notamment dans le milieu judiciaire.
Et là …surprise !!!
Quand on est condamné à une peine maximale sans preuve, on a de quoi se poser des questions sur le fonctionnement des juges dont l’imagination fertile s’oppose aux faits réels et à vos preuves personnelles présentes dans votre dossier.
De l’aspect commercial des contrats, le juge décide et martèle qu’il s’agit de placements financiers. Son jugement est truffé d’incohérences et de mensonges.
En fait, le juge tire un trait sur toutes vos preuves d’innocence pour suivre intégralement les préceptes d’Oswald BAUDOT du syndicat de la magistrature qui disait aux élèves magistrats :
« Soyez partiaux ! Pour maintenir la balance entre le fort et le faible, le riche et le pauvre, qui ne pèsent pas d’un même poids, il faut que vous la fassiez un peu pencher d’un côté (…). Ayez un préjugé favorable pour la femme contre le mari, pour l’enfant contre le père, pour le débiteur contre le créancier, pour l’ouvrier contre le patron, (…) pour le voleur contre la police, pour le plaideur contre la justice. ».
Et il ajoutait encore : « Dans vos fonctions, ne faites pas un cas exagéré de la loi et méprisez généralement les coutumes, les circulaires, les décrets et la jurisprudence. »
Puis « N’attendez pas le feu vert du ministre ou du législateur ou des réformes, toujours envisagées. Réformez vous-mêmes. (…) La loi s’interprète. Elle dira ce que vous voulez qu’elle dise. Sans y changer un iota, on peut, avec les plus solides “attendus” du monde, donner raison à l’un ou à l’autre, acquitter ou condamner au maximum de la peine. Par conséquent, que la loi ne vous serve pas d’alibi. »
Quelle confiance accorder à la Justice après de tels propos ? Que faire si aujourd’hui ou demain, l’un de nous a affaire à la Justice et doit passer devant l’un de ceux qui nous contestent le droit de nous exprimer ?
L’école de la magistrature mériterai d’être supprimée car elle a pour effet d’encaster ces jeunes juges dans un moule à vie (on peut citer ici le juge Burgaud dont tout le monde se souvient).
J’ai écrit à Mme MERKEL en lui demandant de me dire où était passé tout cet argent d’une entreprise dont le capital atteignait 10 millions d’euros. Les biens de l’entreprise et des dirigeants ont été saisis, les bâtiments vendus etc….
Elle m’a répondu que cette affaire était privée et qu’elle ne pouvait rien pour moi (Traduction google)
Une seconde lettre m’a dirigé vers le centre de TVA de BONN à qui je demandais la restitution de la TVA de mes contrats ainsi que celle des contrats des plaignants que le juge m’a condamné à leur rembourser. QUATRIEME PUNITION… l’argument était que ma demande était trop tardive et les normes avaient changées, soi-disant.
Ayant fait l’objet d’une législation d’exception, je me bats depuis mars 2014 contre l’injustice qui m’a été appliquée. Les courriers et plaintes aux différents ministres, présidents de la République, défenseur des droits, inspection générale de la justice, conseil supérieur de la magistrature n’ont pas abouti (le CSM m’a opposé un article de la constitution de 1958). Les juges sont bien protégés… Les Présidents et Ministres destinataires de mes courriers recommandés n’ont même pas répondu. Quel mépris…
De par leurs comportements ces juges méritent d’être poursuivis disciplinairement et ils ne le sont pas. Pour étayer sa décision ce juge me taxe d’un procès d’intention pour lequel il n’existe aucune preuve. Il s’agit bien ici d’idéologie accompagnée de haine.
La lâcheté s’insinue partout. Même le Canard Enchaîné se tait ainsi que la ligue des droits de l’homme qui me répond que le fait d’obtenir un jugement équitable n’est pas un droit fondamental. C’est la politique de l’autruche partout !!
On m’a même caché la date des débats. Ni mon avocat, ni l’avocat d’appel ne m’a prévenu de cette date à laquelle j’aurai pu me présenter de façon à voir et entendre la façon dont j’étais jugé. C’est pourtant mon droit…fondamental… et ils ont été payés pour ça.
Je me suis aussi adressé à l’Institut Pour la Justice, mais comme je ne suis pas un criminel, je n’intéresse personne.
La mascarade pouvait ainsi se jouer sans moi…Le spectacle m’a été interdit.
Je n’ai pas rencontré une telle lâcheté dans l’armée. Je soupçonne une connivence entre avocats …un complot.
Le juge en a pris acte parce qu’ils validaient ses thèses et sa haine. Il démontrait une volonté farouche de me condamner à la peine maximale uniquement avec ses fausses allégations. Il m’a écrasé comme un cafard et radicalement humainement effacé.
J’ai porté plainte pour cette falsification et dévoiement de documents. Ces actes sont réprimés par le code pénal.
J’ai cité dans ma plainte les articles du code qui sont absolument clairs. Le procureur a répondu, 18 mois après mon dépôt de plainte, que ces actes ne sont pas réprimés par la loi.
Donc ce code pénal ne sert à rien. CINQUIEME PUNITION
Je vous le dis. Il y a un complot autour de cette affaire. Tous les responsables se mettent la tête dans le sable.
Danton disait : Quand la politique entre dans le prétoire, la justice en sort. Et je pense que la politique y est pour quelque chose.
Donc, Selon les préceptes d’Oswald Baudot, la loi est une putain que les juges arrangent à leur manière…
Il y a encore une SIXIEME PUNITION que je développerai plus tard, s’agissant ma plainte devant de la cour de cassation.
Cela montre à quel point il est facile de déshumaniser et d’effacer quelqu’un qui ne se défend pas
Cela montre que la majorité des juges (ou même des gens normaux) peuvent devenir très violents si on leur en donne la possibilité. Ils sont plus justiciers que juges.
C’est un peu une affaire Dreyfus moderne, ou comment un innocent a été présenté au public comme coupable. Il avait été conduit au bagne puis réhabilité. Mon bagne à moi, c’est la fracture psychologique suivie de maladies que je ne décris pas ici.
Ceci explique assez bien comment peuvent être construites les FAUSSES VÉRITÉS médiatiques. La presse s’était emparée de cette affaire. Elle l’a même comparé avec l’affaire MADOFF. Décidément ces journaleux n’avaient encore rien compris. C’est juste pour faire du fric.
Je ne peux plus poursuivre ma plainte faute d’argent car surendetté suite à ces jugements iniques. Il me faudrait un soutien financier pour continuer mon action. Le but du juge était bien de me massacrer financièrement afin de m’interdire tout recours ultérieur.
La solution pour atteindre une vraie justice serait de passer les faits à l’intelligence artificielle de façon à constituer un « premier jet » de jugement et ensuite faire intervenir l’humain (je doute que l’humain soit dans la tête des juges). Je ne vois que cette solution pour rétablir une vraie justice, et encore… Et que chacun fasse sa part pour faire rectifier et remettre la justice dans le droit chemin, comme dans la légende du colibri.
Jacques Chirac disait justement : « la maison brûle et nous regardons ailleurs ».
