Quelle est la signification de l’Etat de droit ?
En vérité je ne comprends pas ce que cela veut dire. Si quelqu’un pouvait m’éclairer, il serait le bienvenu.
l’Etat de droit à la française inclut l’idée que la loi défie l’arbitraire. C’est même de cet arbitraire qu’on entend protéger l’individu, quand on échafaude l’Etat de droit, il est pensé pour sécuriser juridiquement l’être humain. Or, si vous lisez bien mes textes précédents vous verrez que cet état de droit ne protège pas les individus et que seuls les juges haineux détiennent la puissance pour condamner uniquement par idéologie.
Pour qui est créé le droit ? A mon sens, il est créé pour ceux qui sont plus égaux que les autres, c’est-à-dire pour ceux qui proclament l’égalité pour tous mais d’abord pour eux-mêmes. Je pense à ceux qui nous gouvernent et à ceux qui nous jugent : les PRÉDATEURS.
Si nous sommes dans un état de droit, plusieurs questions se posent:
Pourquoi la ligue des droits de l’homme considère que le fait de bénéficier d’un jugement équitable n’est pas un droit fondamental (en réponse à ma plainte) ?
Pourquoi les instances politiques ne répondent pas à mes plaintes (Ministre de la justice, Président de la République…) ? Le Tribunal de commerce saisi en février 2020 n’a donné aucune suite à ce jour. Le Procureur saisi fait de même. Seul le conseil supérieur de la Magistrature m’a répondu que les juges ne peuvent pas être punis pour leur erreurs de jugement grâce à un article de la constitution que je n’ai d’ailleurs pas trouvé. Les juges ne se condamnent pas eux-mêmes.
Sur cette planète il y a plus de 7 milliards de vérités. Chacun a la sienne et agit selon elle.
Mais en haut de la pyramide, l’idéologie surpayée emporte tout. Leurs mots puissants manifestent les choses et tuent la base de la pyramide de manière psychologique. La base ne peut rien contre cela.
On peut comparer les juges à des prédateurs qui condamnent selon leur plaisir et leurs préjugés. Et « Il est plus difficile de détruire un préjugé qu’un atome » (A. Einstein).
C’est dire la puissance de nos juges chez qui l’arrogance tient lieu de grandeur. « La vrai grandeur de l’homme réside dans sa conception d’un but honnête, basé sur une appréciation juste de lui-même et des choses, des retours fréquents sur sa conduite, et une soumission aveugle à des règles dont il connait l’équité, ne se préoccupant pas de savoir ce que pensent ou disent ou font les autres » (Marc Aurèle).
Nous ne sommes pas dans un Etat de droit malgré ce que nous martèlent nos dirigeants et notre justice.
Pour qu’il y ait justice il faut que certains oublient ce qu’ils sont. C’est parce que certains peuvent tout qu’ils ne doivent pas se le permettre. Et ce n’est pas parce que certains (les juges) peuvent tout qu’ils peuvent tout se permettre.
L’injustice nous met tous en colère, mais la colère nécessite un besoin de justice et si tu es neutre en situation d’injustice, alors tu as choisi le côté de l’oppresseur. Donc il faut se battre contre l’injustice flagrante.
Nul n’est au-dessus de la loi. Pourquoi les magistrats feraient-ils exception dans un Etat de droit ? Un magistrat qui enfreint la loi délibérément devrait être condamné plus que les simples administrés qui ne sont pas censés la connaître. Son comportement devrait être exemplaire avec le respect de l’impartialité. Or, des magistrats, conscients de leur impunité « font n’importe quoi » comme l’a souligné le juge Van Ruymbeke.
La France donne des leçons au monde entier sur la politique, la justice, et les délégataires de services publics qui étaient l’art de servir les citoyens avec tout le respect qui leur est dû, se contentent d’une lente médiocrité.
Une injustice faite ne fût-ce qu’à une seule personne est une menace pour nous tous.
La Déclaration des Droits de l’Homme et du Citoyen (article 35) cite :
Quand le gouvernement viole les droits du peuple, l’insurrection est, pour le peuple et pour chaque portion du peuple, le plus sacré des droits et le plus indispensable des devoirs.
Les magistrats qui se plaignent feraient mieux de balayer devant leur porte et notamment de regarder les décisions iniques, violentes et souvent hors des cadres légaux qu’ils prennent. Des décisions non respectueuses des droits fondamentaux des personnes et non justifiées par des éléments de preuves. Une honte de la République. Honte à eux. Puisse la « justice » être enfin réformée et pour certaines parties, dissoutes puis refondées sur des bases normales. Les décisions actuelles ne sont pas prises « au nom du peuple », elles sont prises pour beaucoup par des « petits rois » sans contradicteurs. Il faut plus de démocratie et de transparence et pour certains domaines, qu’il devienne plus simple d’attaquer en justice les juges eux-mêmes. On pourrai alors parler d’un Etat de Droit.

La question posée enfin est sérieuse : l’égalité des Français devant la loi est l’un de ces principes qu’on proclame avec d’autant plus de vigueur qu’on appartient à ceux des Français qui sont plus égaux que les autres.
